This document (hereinafter referred to as "This document", "Contract" or "Terms and Conditions") represents the conditions of use of the website https://bilete.peles.ro (hereinafter referred to as the "Site") and the conditions of placing ticket orders for visiting the Peleș National Museum through the website, including delivery and return conditions. By browsing this site or placing an order you agree to the Terms and Conditions described below. This document is a legal agreement – a contract between you and Peleș National Museum. Please, also read our Privacy Policy and Cookie Policy before browsing the site or placing an order. If you do not agree to these Terms or the Policies indicated above, please do not use the Site.

THE CURRENT CONTRACT

Mandatory character. You understand that both this agreement and all policies it refers (e.g., Privacy Policy, Cookie Policy) are binding on you. By browsing our site or placing an order, you are taking the commitment to comply with this contract and the indicated policies.

Changes and updates. Peles National Museum reserves the right to modify these Terms at any time and without prior notice. Your order will be subject to the terms in effect at the time the order is placed. By visiting this website you will find the most recent version of the Terms.

Peles National Museum cannot guarantee that any ticket that has been included on the site at any given time will be available at any time. We reserve the right to stop selling a ticket at any time.

YOUR PERSONAL INFORMATION

The website processes personal data provided by you or collected from other sources as described in detail in the Privacy Policy available at https://bilete.peles.ro/politica-de-confidentialitate.

Peleș National Museum complies with national and European legislation on the protection of personal data and the free movement of such data.

By visiting and/or using the site, placing orders or by interacting by any method and/or any means of remote communication, you consent to the processing of your personal data as described in our Privacy Policy available at https://bilete.peles.ro/politica-de-confidentialitate.

You also declare that all personal data and information transmitted to Peleș National Museum are correct. To the extent that the data does not belong to you, you have to declare that you have obtained the prior written consent of the data subject whose data you are transmitting to Peleș National Museum or you declare that you are transmitting the data based on another legal basis according to Regulation (EU) no. 679/2016.

ELIGIBILITY

In order to legally place an order on Peleș National Museum’s site you must (1) agree to this Contract; and (2) provide true, complete and current identity and contact information.

RULES REGARDING THE USE OF THE WEBSITE

Rules. By accessing, visiting, placing an order or performing any other activity on Peleș National Museum site, you are supposed to comply with the following rules:

1. This website is to be used exclusively for legitimate orders or for information.

2. You will not place any false or fraudulent order; otherwise Peleș National Museum reserves the right to cancel the order and inform the relevant authorities or to take legal action in order to recover any damages caused by any false or fraudulent order.

3. Information provided by any user is to be true, accurate, complete and up-to-date.

4. You will respect the intellectual property rights of any material found on this site.

5. Peleș National Museum reserves the right to take legal action in order to recover any damage caused by any kind of action that could bring any kind of damage to our site.

Consequences. Peleș National Museum reserves the right to block the access of any user who violates the above rules, to cancel orders, to notify the competent authorities for administrative/criminal prosecution of any anti-social acts and to take legal action for the full recovery of any damages caused, present or future, including unrealized benefits and court costs (including attorneys' fees).

CONCLUSION OF THE CONTRACT

Date of conclusion of the contract. The contract between you and Peleș National Museum comes to an end when your order is expressly accepted by the museum and you will receive an email to confirm the delivery.

Protection. You will be refunded as soon as possible if an order is not accepted but you have already been charged.

The decision is ours. Peleș National Museum reserves the right to decide, unilaterally and without specifying the reason, whether or not to conclude a sales contract. It will have no liability to you if an order is refused to be fulfilled. Title to the tickets will only pass to you once you have paid all amounts due for the tickets.

AVAILABILITY OF TICKETS

Peleș National Museum cannot guarantee that the tickets found on the website at any given time will be available for purchase at any time. The museum will have no liability to you in the event that a ticket is no longer available on the site. Although any information regarding tickets’ availability will be updated on the website in real time, the museum cannot guarantee that this information will be updated at all times. All orders will be subject to ticket availability. 

Guarantees. To the extent that tickets are unavailable but you have already placed your order, you will be informed of the unavailability of these tickets and you will be recommended similar tickets of equal or similar value that can be ordered. If you do not wish to order the similar tickets recommended by the museum, the order will be cancelled, and if you have already paid the price of the tickets the money will be returned as soon as possible.

TICKET PRICE. PAYMENT. DELIVERY

The ticket price is displayed in lei on the website and includes VAT. If there is an error regarding the price displayed on the website, you will be notified as soon as possible, and the additional amount paid will be returned or an additional amount will be requested. If the new price is not satisfactory to you, you do not respond to our request or we are unable to contact you, your order will be cancelled and the amount paid will be returned as soon as possible.

Ticket prices may be updated/changed at any time and such update/change will supersede any previous price. Your order will be charged at the time the order is actually placed.

The payment is possible by online card payment only.

In the case of online payment with a bank card, the processing of your card data is done through EuroPayment Services S.R.L. (euplatesc.ro), thus no data related to your card will be stored by Peleș National Museum.

When paying by card, the issuing institution will proceed to validate and authorize the payment. In the event that the transaction is not processed for reasons beyond the museum’s control (e.g. non-existent funds on the card, expired card), the contract between you and the museum is not concluded and the museum will have no obligation to deliver the tickets; however, you can try processing the payment again with a valid card.

The Peles National Museum is not responsible in any way, to any extent, and bears no responsibility for the card payment processing service, services independent of the Peles National Museum. Consequently, the Peles National Museum is not responsible for any type of error related to online payment and/or any type of fraud resulting from online payment. However, the Peleș National Museum will make every effort to ensure the prevention of these errors and/or fraud attempts.

After payment, the ticket will be delivered to you electronically via the valid email address you provided when placing your order on the website.

Full payment for the ticket is made at the time of purchase, and the electronic ticket is sent to the Customer by e-mail shortly after the purchase is completed. If the payment is made fraudulently using a lost/stolen credit/debit card or if the credit/debit card is used without the card owner's permission, the Peleș National Museum reserves the right to cancel such purchased tickets without refunding to the fraudulent buyer.

The delay in delivery will not be due to our actions or omissions, but to an event external to us, in which case you agree not to hold us liable under any circumstances.

ELECTRONIC TICKET USE POLICY

Electronic tickets are valid for 30 days.

Electronic tickets can only be used during the opening hours and only up to the maximum hours provided for access. It is the Client's responsibility to be informed about the museum’s opening hours and about the opening hours for every type of tours.

The Peles National Museum will not be held responsible and will not refund the ticket price if entry is refused for any reason, including but not limited to: uncontrolled, dangerous, disruptive behavior, illegal behavior that results in denial of access.

Tickets cannot be resold for more than the original purchase price. In the event that a ticket is found to be resold for commercial gain at a price higher than the original purchase price, the ticket will be cancelled without refunding to the purchaser and it will not be valid for entry.

Customers are required to protect their electronically issued tickets from loss or theft. The Peles National Museum is not responsible for replacing lost or stolen tickets and does not grant refunds for lost or stolen tickets. If a customer's e-ticket is copied/stolen (eg: by email hacking or delivery to an email address shared with someone) and the e-ticket is used and scanned before that Customer enters the museum, the customer will be denied access because the tickets were invalidated at the time of first use. The customer will not receive any refund in this case. Customers are advised to protect their electronic tickets with the same care and attention as they would protect a physical printed ticket from theft.

The Peles National Museum reserves the right to carry out a security check at any time in order to ensure safety and security in the museum.

By using a ticket purchased through www.bilete.peles.ro, you agree to be photographed, filmed or recorded by the Peles National Museum or by any third party operating on behalf of the institution.

FORCE MAJEURE AND FORTUITOUS CASE

Peleș National Museum will not be liable for any delay or failure to perform our services if there is a force majeure or a fortuitous case. Force majeure includes but is not limited to changes in laws or regulations, embargoes, wars, acts of terrorism, riots, fires, earthquakes, nuclear accidents, floods, strikes, epidemics, pandemics, weather conditions, and acts of hackers or Internet service providers.

RIGHT OF WITHDRAWAL

According to OUG 34/2014, if you are a costumer (private person) you have the right to withdraw from the contract, without any specific reason, within 14 days from the day you or a third party authorized by you, came into possession of the tickets.

If the online ticket was validated upon entering the museum by scanning the QR code, the ticket is considered used and cannot be refunded.

The value of the electronic ticket can no longer be refunded if the 30-day validity period has expired.

În cazul biletelor de grup, dacă numărul persoanelor din grup care se prezintă la muzeu este mai mic decât numărul de persoane al grupului pentru care s-au achiziționat biletele, iar biletele au fost validate la intrarea în muzeu, acestea vor fi considerate folosite și nu se mai pot rambursa parțial sau integral.

COPYRIGHT AND RELATED RIGHTS

Întregul conținut al site-ului este proprietatea intelectuală a Muzeului Național Peleș. Site-ul poate fi folosit de către terți doar pentru informare și/sau plasare de comenzi.

Website users have no right to download, partially or fully modify the website, reproduce partially and/or fully the website, copy, distribute, sell or exploit the website in any other way contrary to the interests of the Peleș National Museum, regardless whether or not there is a commercial purpose.

All content (including but not limited to databases, graphics, trademarks, legal content) are the intellectual property of Peleș National Museum. The entire site is protected by Law no. 8/1996 on copyright and related rights, and for any infringement of intellectual property we reserve the right to refer the competent courts for the full recovery of the damage, as well as to file a criminal complaint with the judicial bodies for the criminal prosecution of the perpetrator.

FINAL TERMS

These Terms constitute the entire agreement between you and Peles National Museum with respect to the subject matter of any Contract and supersede any other prior agreement, oral or written understanding between you and us.

This Contract is binding. You may not transfer, assign, pledge or otherwise dispose of this Agreement or any of your rights or obligations hereunder without museum’s prior written consent. Peleș National Museum may transfer, assign, pledge, subcontract or alienate in any other way a Contract or any of its rights or obligations under the Contract. This Agreement, as well as any use of the site, will be governed by Romanian law. Any dispute will be submitted to a Romanian court for resolution.
